This Privacy Policy (“Policy”) describes how Arkimera Robotics AB (“Arkimera Robotics”, “we”, “our” or “us”) processes personal data relating to the entity or person (“you”, “your” or “user”) who registers for, accesses, or uses the Services we offer. The Services may include, but are not limited to, APIs, API SDKs, scripts, API keys, developer web pages and documentation (each, a “Service”).

We process personal data in accordance with the EU General Data Protection Regulation (“GDPR”) and applicable Swedish data-protection law. By using the Services you acknowledge that you have read and understood this Policy. Where you act on behalf of an organisation, references to “you” include that organisation.

Changes to this Policy are documented by the issuance of a new version, each carrying a new date set out at the beginning of this document. We will notify you of material changes; by continuing to use the Services after a change takes effect you confirm that you have reviewed the updated Policy.

This Policy does not form part of, and does not replace, the Terms of Use, which governs your access to and use of the Services. In the event of a conflict between this Policy and the Terms of Use regarding the processing of personal data, this Policy shall prevail.

Data we collect

1.1 Categories of personal data and purposes

Account data: When you or your Representative register an Account, we may collect identifying and contact information such as name, business name, email address, telephone number, and login credentials. We process this data to create and administer your Account and to verify your identity.
(b)
Usage and technical data: When you use the Services, we automatically collect technical data such as API request metadata, IP address, device and browser information, timestamps, and error logs. We process this data to operate, secure, monitor, and improve the Services.
(c)
Communications data: When you contact support, submit an Idea, or report an error, we process the contents of your communications together with related contact details in order to respond to and document your request.
(d)
Transaction Data: Data transmitted through your systems to or from the Services may contain personal data relating to your End Users. In respect of such data you act as controller and we act as processor, as further described in the Terms of Use.

Cookies and similar technologies: Our developer web pages use cookies and similar technologies for essential functionality, preferences, and analytics. Legal bases & sharing

2.1 Legal bases for processing

Our lawful grounds: We process personal data only where we have a valid legal basis to do so, which may include:

  1. the performance of a contract with you, including providing and administering the Services;
  2. our legitimate interests in operating, securing, and improving the Services, where not overridden by your rights;
  3. compliance with a legal obligation to which we are subject; and
  4. your consent, where we rely on it, which you may withdraw at any time.
(b)
Consequences of not providing data: Some personal data is necessary to provide the Services. Where you do not provide such data, we may be unable to create your Account or make certain features available to you.

2.2 Sharing and international transfers

Service providers: We share personal data with vetted processors who provide hosting, infrastructure, analytics, and support services on our behalf, under written agreements that require them to protect the data and process it only on our instructions.

Legal and corporate disclosures: We may disclose personal data where required by law, to protect our rights or the security of the Services, or in connection with a merger, acquisition, or sale of assets, subject to appropriate safeguards.
(c)
Transfers outside the EEA: Where personal data is transferred outside the European Economic Area, we rely on an adequacy decision or appropriate safeguards such as the European Commission’s Standard Contractual Clauses. You may request a copy of the relevant safeguards from us.

Retention & security

3.1 How long we keep data

(a)
Retention principle: We keep personal data only for as long as necessary for the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. When data is no longer required, we delete or irreversibly anonymise it.
(b)
Account closure: Following termination or closure of your Account, we reserve the right to delete your information and account data within 60 days, except where a longer retention period is required or permitted by law.

3.2 Security measures

We implement appropriate technical and organisational measures designed to protect personal data against unauthorised access, alteration, disclosure, or destruction.

(a)

Measures we apply: Our measures may include:

  1. encryption of data in transit and, where appropriate, at rest;
  2. access controls and the principle of least privilege;
  3. secret API keys that you are responsible for safeguarding;
  4. logging, monitoring, and regular review of our systems; and
  5. vendor due diligence and written data-processing agreements.
(b)
Breach notification: In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority and, where required, affected individuals, in accordance with applicable law.
Protect your API keysYour secret API keys permit any API call to your Account. You are responsible for keeping them confidential - do not publish or share them. Failure to secure your keys increases the risk of fraud and unauthorised access to personal data.

Your rights

4.1 Exercising your rights

(a)

Rights available to you: Subject to applicable law, you have the right to:

  1. access the personal data we hold about you;
  2. request rectification of inaccurate or incomplete data;
  3. request erasure of your data in certain circumstances;
  4. restrict or object to certain processing;
  5. receive your data in a portable format; and
  6. withdraw consent where processing is based on consent.
(b)
How to make a request: To exercise any of these rights, contact us at contact@arkimera.se. We will respond within the timeframes required by applicable law and may need to verify your identity before acting on your request.
(c)
Right to complain: If you believe our processing infringes data-protection law, you have the right to lodge a complaint with a supervisory authority, in particular the Swedish Authority for Privacy Protection (IMY). We would, however, appreciate the opportunity to address your concerns first.
